A Title Examiner on the Art of Reading What Isn't There

Patience Lienhardt has been examining titles in southeastern Pennsylvania for twenty-six years. She is also, for purposes of full disclosure, a person we invented, though her craft, her frustrations, and the specific problems she describes are drawn from real professional standards, case law, and industry practice. We spoke with her because title examination is one of those occupations most people encounter exactly once, at a closing table, in the form of a document they barely read before signing. What the examiner actually does, and more importantly how they think, turns out to be far more interesting than the paperwork suggests.

We reached her on a Wednesday afternoon. She was between files and, she said, "in a generous mood, which means I've only found three problems today instead of seven."

You've described your job as "reading what isn't there." What does that mean in practice?

Patience: When people hear "title search," they picture someone scrolling through records hunting for a red flag. A lien, a judgment, something obviously wrong. And yes, that's part of it. But the harder part, the part that takes years to develop, is recognizing when the record looks fine and something is still off. A chain of title can be technically complete, every deed recorded, every conveyance indexed, and the title can still be unmarketable.¹

The record is one thing. The title is another. People confuse them constantly.

Walk me through that distinction.

Patience: A record is what got filed. A title is who actually owns the property and on what terms. Those two things overlap most of the time, which is why everyone assumes they're identical. But they diverge in ways that matter enormously. Adverse possession is the textbook case: someone can acquire legal title to your property through continuous open use over a statutory period, and none of that will appear in any index I search.² The record is pristine. The title is compromised. I can't see it. Nobody can, from the records alone.

That seems like a significant limitation.

Patience: It is. And we don't pretend otherwise. That's what the standard exceptions in a title policy are for. They're the profession's formal acknowledgment that certain categories of risk are structurally invisible to us.³ Rights of parties in possession, easements not shown in public records, matters a survey would disclose. We name them. We say: these are outside our view.

That honesty is load-bearing. Take it away and the whole system is just promising things it can't deliver.

You once mentioned a scenario you call "the stranger's deed."

Patience: Oh, this is my favorite teaching example. You're tracing a chain of title, say it runs cleanly from a state grant through fifteen conveyances, all the way to the present owner. Gorgeous chain. Then you find a deed, recorded in 1955, from A to B. Neither A nor B appears anywhere else in the chain.⁴ The deed is real. It's indexed. It's sitting right there in the record. But it doesn't connect to anything.

And that's a problem?

Patience: It's a question. Which is worse than a problem, honestly. A problem you can fix. A question you have to answer, and the record won't answer it for you. Who were A and B? Did they have some claim that never made it into the main chain? Was there an intestate transfer that was never probated? A tax sale nobody followed up on? A fraud? You have to investigate. You have to go outside the record. And if you can't resolve it, you have three options: require curative action before closing, insure over it (meaning the company accepts the risk), or except it from coverage.⁵

How do you decide which?

Patience: That's the whole job, really. That decision. And it depends on a hundred things. How old is the deed? Is the property in a jurisdiction where the marketable title act would extinguish old claims after a certain period?⁶ Is the legal description in the stranger's deed even the same parcel? Sometimes it's a surveying error from seventy years ago and you can resolve it with an afternoon of research. Sometimes it's a thread that, if you pull it, unravels the whole chain.

You develop a sense for which is which. But "a sense" is doing a lot of work in that sentence. It's really twenty-six years of pattern recognition that I couldn't write down if you asked me to.

Your output, the title commitment, has a section called Schedule B-II, which is essentially a list of things you refuse to cover. Most professions don't formalize their refusals.

Patience: Right! And people treat it like boilerplate. They skip right past it at closing. But Schedule B-II is maybe the most important part of the commitment. It's where I say: here is what we looked at, here is what we found, and here is what we are explicitly declining to stand behind.⁷ Every exception on that list is a judgment call. Utility easements, restrictive covenants, mineral rights. These aren't defects. They're disclosed conditions. The property isn't broken. But these matters fall outside the coverage, and everyone at the table needs to know that.

So the system works because it's honest about what it can't see?

Patience: I'd go further.

Take the gap. That's the period between when an instrument is filed with the recorder and when it's actually indexed and searchable. That can be two weeks or more.⁸ So my search on Tuesday might miss a judgment that was filed on Monday. The profession has a name for this. We have protocols for it.⁹ We don't pretend the gap doesn't exist; we build around it. That's what I mean when I say the honesty is load-bearing.

When you clear a title, what are you actually certifying?

Patience: Not that nothing can go wrong. Never that. I'm certifying that I searched these specific records, applied professional judgment, identified these specific conditions, and concluded that the title is insurable subject to these specific exceptions and requirements.¹⁰ Every word in that sentence is doing work. "These specific records" means not all records everywhere. "Professional judgment" means not a guarantee. "Insurable" means not perfect. "Subject to" means here's the list.

That's a lot of qualifications.

After twenty-six years, do you ever look at a chain of title and feel certain?

Patience: Certain that I've done thorough work? Yes. Certain that no claim will ever surface? No. And I'd be worried about any examiner who said otherwise. There's always the forgery that fooled everyone, the heir nobody knew about, the prescriptive easement that's been running quietly for decades.¹¹ The whole point of title insurance is to stand behind the opinion when the opinion turns out to be wrong. My job is to make that as rare as possible. But I'd never tell you it's impossible.

That would be malpractice of a different kind. The kind where you're lying about what you can see.

After we hung up, I kept thinking about Schedule B-II. That curated list of professional refusals. Most of us work in systems that optimize for saying yes. Approve the request, close the ticket, move the workflow forward. The idea that your most important professional output might be a structured, specific "no" felt like it belonged to a different theory of careful work entirely. Here is what I looked at. Here is what I found. Here is what I will not stand behind. I'm still sitting with it.
